Lilith Noir - Terms of Service

1. Acceptance of Terms Welcome to Lilith Noir. By accessing our website (luminousluxcrafts.com) and/or placing an order, you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not use our website or purchase our products.

2. Products & Orders All products available on our website are handcrafted and made-to-order. This means production begins only after your order payment is confirmed. We reserve the right to refuse or cancel any order at our discretion.

3. Production & Shipping

  • Production Time: As items are made-to-order, please allow approximately 3-5 workdays for the production of your item after your order is confirmed. Production times are estimates and may vary based on order volume, design complexity, material availability, or during public holidays. We will notify you if significant delays are expected.
  • Shipping: Once production is complete, your order will be dispatched using reliable carriers (such as USPS for domestic orders or appropriate international carriers).
  • Estimated Delivery Time: Estimated delivery transit time is approximately 4-5 workdays after dispatch. Please note this is an estimate only. Delivery times are not guaranteed and may be affected by factors beyond our control, including but not limited to weather conditions, natural disasters, carrier delays, and customs processing (for international orders).
  • Shipping Address: You are responsible for providing a complete and accurate shipping address. We are not liable for orders lost or delayed due to incorrect or incomplete addresses.

4. International Orders, Customs, and VAT

  • General Customs Responsibility: Customs regulations vary significantly by country. The buyer is solely responsible for understanding and complying with their country's customs regulations and for paying any and all associated import duties, taxes (unless collected by us under IOSS for eligible EU orders, see below), and fees. Lilith Noir has no control over these charges and cannot predict what they may be. We recommend contacting your local customs office for more information before placing an order.
  • EU Shipments & IOSS (Import One-Stop Shop):
    • For orders shipped to addresses within the European Union (EU) with a total consignment value not exceeding €150, Lilith Noir collects VAT at the point of sale in compliance with the EU's IOSS scheme. Our IOSS number will be electronically provided to the customs declarant (carrier).
    • When IOSS is used correctly for eligible orders (under €150), you should not be charged additional import VAT or customs clearance handling fees by the carrier upon delivery.
    • Important: This IOSS procedure applies only to VAT for consignments valued up to €150 shipped to the EU.
  • Orders Over €150 (EU) & Non-EU Orders: For orders shipped to the EU exceeding €150 in value, and for all orders shipped outside the EU, the buyer remains responsible for all applicable import duties, taxes (including VAT), and customs clearance fees levied by the destination country.
  • Customs Delays: Customs clearance procedures can cause delays beyond our original delivery estimates.

5. Pricing & Payment

  • All prices listed on our website are in US Dollars (USD) unless otherwise stated and are subject to change without notice.
  • Payment is required in full at the time of purchase through the available payment methods on our website.
  • Prices displayed may include VAT for eligible EU orders under €150 collected via IOSS at checkout. For other orders, prices do not include shipping costs or any applicable taxes or duties, which will be added where applicable or be the responsibility of the buyer upon import.

6. Returns, Refunds & Exchanges

  • Custom Nature: Due to the made-to-order and often personalized nature of our products, we generally do not accept returns, issue refunds, or offer exchanges, unless the item you receive is defective or there was a significant error made on our part in fulfilling your order.
  • Reporting Issues: If you believe you have received a defective or incorrect item, please contact us at info@thelilithnoir.com or hakan@thelilithnoir.com within 14 days of receiving your order. Please include your order number, a description of the issue, and clear photographic evidence. We will assess the situation and determine the appropriate resolution on a case-by-case basis, which may include a replacement or refund.

7. Limitation of Liability To the fullest extent permitted by law, Lilith Noir shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the products; (b) any conduct or content of any third party related to the products; or (c) unauthorized access, use, or alteration of your transmissions or content. In no event shall Lilith Noir' aggregate liability exceed the total amount paid by you for the product(s) giving rise to the claim.

8. Governing Law These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within Turkey for the resolution of any disputes arising out of or relating to these Terms or your use of our services or products.

9. Changes to Terms We reserve the right to modify these Terms of Service at any time. Any changes will be effective immediately upon posting the updated Terms on our website. Your continued use of the website or placement of orders after such changes constitutes your acceptance of the new Terms.
